EXPEDITE REQUEST. Request for expedited processing

According to surveys, the average processing time for employment authorization applications is three months or longer. Processing times for other applications, such as advance parole or travel documents, have exceeded one year.

There is a way to speed up the review of an application — by submitting an Expedite Request to USCIS.

Applicants for immigration benefits may request that USCIS expedite the processing of their applications or petitions. USCIS reviews expedite requests on a case-by-case basis and may request additional documentation. Approval of an expedite request is entirely at USCIS’s discretion.

Circumstances (criteria) under which expedited processing may be considered:

  • severe financial loss to a company or individual*;
  • emergencies and urgent humanitarian reasons;
  • requests from a nonprofit organization in furtherance of cultural or social interests of the United States;
  • U.S. government interests;
  • correction of a USCIS error.

* Late filing of a form or failure to respond to USCIS requests for evidence is not a valid reason for expedited processing.

Severe financial loss to a company or individual

A company may demonstrate severe financial loss if it faces bankruptcy, loss of a critical contract, or layoffs of employees.

The mere need for employment authorization, without additional compelling factors, is not sufficient grounds for expedited processing.

Financial loss may also be established when failure to expedite would result in the loss of essential public benefits or services.

This criterion is often used to expedite employment authorization applications.

The employer should confirm:

  • the urgent need to hire you;
  • the consequences of delay (for example, loss of a contract);
  • company details and contact information.

Emergencies and urgent humanitarian reasons

Humanitarian reasons are those related to the well-being of people and may include illness, disability, extreme living conditions, death of a family member, or an urgent need to travel for medical treatment within a limited time.

A desire to travel for vacation generally does not qualify as an emergency.

This criterion may be used to expedite travel document processing. You must clearly describe your situation and provide supporting evidence.

Correction of a USCIS error

If USCIS made a clear error and denied your Form I-765, you may refile the form together with an Expedite Request.

Important:

  • none of the reasons guarantees expedited processing;
  • USCIS does not explain reasons for denying expedite requests.
