If an immigration judge grants you asylum, congratulations. You have successfully completed one of the most difficult stages of the process.
The government may appeal the immigration judge’s decision to the BIA. The government must file a Notice of Appeal within 30 days of the judge’s decision. During this period, you should check the status of your case to see whether an appeal has been filed.
If the government files an appeal, you will need to continue participating in the appeal process. The BIA will mail you a notice with information about the deadline for submitting written arguments. At this stage, having an attorney is especially helpful.
If the government does not file an appeal, the judge’s decision becomes final, and you and the family members included in your application will be granted asylum.
You may apply for an employment authorization document that reflects your asylum status, although you are already authorized to work.
You may also immediately apply for lawful permanent residence (a green card).
In addition, you may apply to bring your spouse and children who are outside the United States to join you.
