Who needs to file Form I-589?

Form I-589 must be filed by anyone who is seeking asylum in the United States.

It does not matter how you entered the country — whether you crossed the border through Mexico or arrived with a visa. If you are fleeing persecution and seeking protection, you are required to file Form I-589.

You may apply for asylum in the United States if you were persecuted or fear persecution based on one or more of the following grounds:

Race
Religion
Nationality
Political opinion
Membership in a particular social group
