How should Form I-589 be filed with USCIS: online or by mail?

Filing Form I-589 online is generally recommended.

In its public statements, USCIS emphasizes that expanding online filing is a priority, as it makes operations more efficient for both the agency and applicants. USCIS has also stated that it plans to continue adding more forms for online submission and reduce reliance on paper filings.

A key practical advantage of online filing is that you usually receive Form I-797C, Notice of Action within 72 hours. When filing by mail, the wait time can be up to six months.

You may file Form I-589 online if you:

  • entered the United States with a visa;
  • do not have an A-Number;
  • were not issued Form I-862 (Notice to Appear) and are not in immigration court;
  • have never been in immigration court and your case has never been closed;
  • are not currently listed as a dependent on another asylum application, even if the family relationship later ended (for example, after divorce).

You cannot file Form I-589 online with USCIS if:

  • you were issued Form I-862;
  • you are in immigration court or in an appeal process;
  • you have already filed Form I-589 (for example, by mail) and it is still pending;
  • you are an unaccompanied minor in removal proceedings;
  • special instructions apply to your case, including situations where:
    • you were previously in immigration court (including cases closed through prosecutorial discretion);
    • each family member is filing a separate application as a principal applicant;
    • you were previously listed as a dependent on another application and now must file your own Form I-589.

What may happen if you file online despite restrictions?

As warned during the filing process, your application may be rejected or accepted but later dismissed. In such cases, you lose valuable time and, in some situations, important procedural benefits.
