It all depends on where the form was filed and how it was filed.
If you are not in the court system, you could file Form I-589 only with USCIS.
1. Filing Form I-589 online with USCIS
If you or your attorney file Form I-589 online through the account at https://my.uscis.gov/, the acceptance notice (Form I-797C) appears in your online account in the Documents section within 72 hours (often within minutes) after submission.
A receipt number is assigned immediately and appears on the main page of the account.
2. Filing Form I-589 with USCIS by mail
If Form I-589 was sent to USCIS by mail, the acceptance notice (Form I-797C) is mailed to the address listed on the application.
In 2022, the wait time for this notice reached up to 6 months.
Until the notice is received, there is no way to verify that the form was accepted other than tracking the mailing via the postal tracking number.
For this reason, USCIS recommends filing online.
At this time, USCIS does not provide a public clock.
If you are already in the court system, Form I-589 must be filed only with the court (EOIR), except in certain limited cases.
3. Filing Form I-589 with the court online (through an attorney)
If an attorney filed Form I-589 online with the court, the attorney also receives an online acceptance notice.
The attorney’s account shows an action history, and they can provide screenshots as proof of filing.
4.1. Filing Form I-589 with the court by mail or in person
If you or your attorney filed Form I-589 with the court by mail or in person, in most cases no acceptance notice is issued.
Instead, the indication that the form was accepted is the start of the “clock” — the day counter for employment authorization.
You can check the clock by calling +1-800-898-7180 (only for those who filed with the court).
To hear the number of days, enter the following sequence:
1 – 1 – A-Number – 1 – 1 – 2
If the automated system says “No clock”, this means the form was likely not accepted or the clerk failed to start the clock.
Starting the clock may take 2–4 weeks, but it will be credited retroactively from the date the court received the form.
If the clock has not started after 2–3 weeks, you should call the court and ask the clerk why the clock has not been started.
4.2. Requesting a stamped copy of Form I-589
If you filed Form I-589 with the court by mail or in person, you may also request a copy of the form stamped as received. The stamp will show the acceptance date.
